User Agreement

 

Please read this user agreement before you use the Og Travel application. You represent that you are of sufficient age to use this application and account for any liability that you may incur as a result of usage of this application.

This agreement is intended to the customers or users who browse or purchase the products & services offered by Og Travel. By using this application and/or using it, you agree to these terms and conditions.

The application and its contents are copyrighted and owned by Og Travel, with head office at Awtad Tower, 11^th Floor, Fahad Al Salem Street, Kuwait City, State of Kuwait.

All rights and liabilities of the User with respect to any services to be provided by Og Travel shall be restricted to the scope of this agreement.

You agree to be responsible for all payments due to us for bookings made by you and anyone else using your login information.

Please ensure that you have gone through our Privacy Policy (shown below).  For queries regarding Cancellation and Date Change charges, please refer Rules and Restrictions (shown below). 

Governing Law

 

This user agreement is governing by the law of the State of Kuwait. Any disputes or differences arising under this user agreement shall be subject to the jurisdiction of the courts of State of Kuwait.

 

Travel Documents

 

It is the sole responsibility of the user to carry all the necessary passport, visa and immigration requirements. We do not hold responsibility if the user is unable to travel due to non-compliance with applicable law. 

 

Advertisements

 

Og Travel holds no responsibility for the genuineness of the contents displayed by advertisers on the application. Og Travel will not be responsible for any omissions or errors or any inconvenience caused due to them. Users shall verify the information provided by third party advertisers.

 

Disclaimer of Warranty and Limitation of Liability

General

 

Your access to and use of software and other materials on, or through, this Web Site is solely at your own discretion and risk. We make no warranty and/or guarantee whatsoever about the reliability, operation, stability or virus free nature of such software.

We take constant steps to ensure that the information provided by us on the application is accurate. However, we do not guarantee the accuracy of information posted on our application by any third parties.

We aim to provide an uninterrupted and error free application. However, this cannot be guaranteed due to the nature of internet. Henceforth, we have the right to modify services on the application without notice.

In case of maintenance activities of the application, your access to the application may be temporarily suspended.

Accounts and Passwords

 

You shall treat your login credentials i.e., User id and password as confidential always and refrain from sharing. Any payments due from your login credentials shall be payable by you.

If you suspect any fraud from your Og Travel account, you shall inform our customer care.

We reserve every right to suspend your Og Travel account in case of any breach of our Terms & Conditions.

Disclaimer of warranty

 

Og Travel DISCLAIMS all warranties and/or guarantees relating to the information, software, products and/or services contained in this application, to the maximum extent permitted by applicable law. All such information, software, products and/or services are provided on an “AS IS” basis without warranty of any kind. We hereby disclaim all warranties and conditions with regard to all such information, software, products and services contained in this application including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement.

Limitation of liability

 

In no event will Og Travel be liable for any claims, liabilities, losses, judgments, suits, damages, penalties, fines, duties, taxes, or similar arising out of or in connection with (and irrespective of jurisdiction): access to, or use of this application, or delay or inability to use this application, or any information contained in this application; or, any matter arising out of or in connection with these terms and/or the application; or the availability and utility of products and services whether or not they are direct, special, indirect, incidental, consequential (including among other things loss of, business, revenue or profits), and/or loss of business opportunity, goodwill or reputation, loss of opportunity in any form, punitive, or exemplary, damages of any kind or subject to equitable or injunctive remedies (whether based on breach of contract, tort, negligence, strict liability or otherwise) even if foreseeable.

Any carriage by air using a booking obtained using this application shall be subject to the conditions of carriage of the relevant carrier and may also be subject to the Warsaw Convention or Montreal Convention, which may limit the carrier's liability in certain circumstances.

Any rights not expressly granted herein are reserved by us.

Indemnity

 

As a condition of use of the Og Travel application, you agree to indemnify and hold us harmless from and against any and all liabilities, expenses (including attorney's fees) and damages arising out of claims resulting from your use of the Og Travel application, including without limitation any claims alleging facts that, if true, would constitute a breach by you of these terms and conditions.

 

Modifications in Agreement

The agreement might undergo changes at any time without advance notice. Modified Agreement will become effective once posted on the application. Your usage of this application after change implies your agreement to the new terms and conditions.

Rules and Restrictions:

• Any increase in airfare or taxes or hotel fares, until the payment is completed in full, will be intimated and charged to you.
• Until the payment is completed in full, the booking is subject to cancellation by the service provider or Og Travel without prior notice.
• If the payment is not approved on given credit card number(s), you will be notified as soon as possible. You may either contact your credit card company, or provide alternate credit card number, or change mode of payment as applicable.
• Payment by Og Travel Wallet is an advantage provided by Og Travel. Refer Og Travel Wallet’s Terms & Conditions for details.
• Any error on the booking/ ticket should be reported within 24 hours of getting booking confirmation email.
•  Cancellation (this will apply to all passengers in the ticket) can be done only for refundable tickets.For Cancellation please contact our 24*7 customer support at  +965 22240111 , +965 22240110  Cancellation charges may vary depending on the airlines you have chosen to fly with. For every Cancellation, a Og Travel cancellation charge of KWD 25 is applicable.
• Og Travel is not responsible for any loss/ damage of shipment.
• Og Travel is not responsible for any schedule change by the airline after issuance of the ticket.
• Og Travel does not hold responsibility of flight cancellation or delay or any losses due to this. Og Travel will not arrange for accommodation or alternate mode of transport in either cases
• All tickets are subject to cancellation penalties. Please note that partially or half-utilized tickets are non-refundable.
• The modification and cancellation penalties of the ticket may vary depending on the airlines.
• If passengers do not board i.e., NO SHOWS, customers shall contact their respective airline for refunds. They may or may not be depending on the airline policy.
• In the case of fares which are discounted, depending on certain rules and regulations, airlines may restrict upgrade of ticket from one cabin class to any higher class. For any clarifications, please contact the respective airlines.
• All discounted tickets have a ticket validity within which the travel has to be finished, and date change on the ticket can be done only as per the validity of ticket. Should you require further details on this, kindly contact your respective airline or our customer care for further guidance.
• Infant is defined as a traveler whose age must be under 24 months throughout the entire journey. If the infant is 24 months or above on the return journey then the infant fare would not be applicable and you will need to buy the ticket under applicable child fare.
• We allow only a maximum of one infant to travel with an adult.
• We do not allow children to travel alone (Unaccompanied Minors). They must be accompanied by an adult (above 12 years of age).
• All bookings booked on Og Travel.net are subject to cancellation penalty levied by the airlines.
• All refunds will be processed to your card/Og Travel wallet, as the case may be, used while booking within 12-14 business days.
• Before the commencement of your air travel, please check that you possess all the valid documents required for travel: passport, air tickets, valid VISA, health certificates, travel insurance, etc. Contact consulate/ airline for further details. Og Travel will not be responsible for any non-travel due to non-possession of required documents.
• Travellers must carry their E-ticket for Flights check in to get your boarding pass.
• You are requested to consult embassy/consulate/airlines to check the visa requirement for your travel. Og Travel will not be responsible for any visa related information.
• Passengers are requested to review travel prohibitions, warnings and announcements of the respective destinations while travelling to international destinations. Og Travel will hold no responsibility of any consequences that might come due to insufficient knowledge of the above.

Privacy Policy

This privacy policy applies to the application of Og Travel. This policy does not apply to our business partners or any other third parties. By Business Partners, we refer to any vendor or other entity with whom Og Travel has a business relationship to offers their services. We recommend you to review the privacy policies of any other parties you interact with.

The following terms and conditions govern the collection and use of personal information. We take sincere responsibility to safeguard your personal information. We consider your information highly confidential. This policy shall be applicable to users who visit our application or avail the products or services from this application as a registered user or a guest (no login).This policy explains what information will be requested from users as well as how it shall be used.

Personal Information

Personal information refers to all information linked to an individual such as name, address, telephone, Email Address ,date of birth, gender, credit/debit card number, card holder name, Passport Expiration Date , details of travel , co-passengers , and all other information requested during usage of services of this application or visiting this application. We may also request information such as your interest to subscribe for newsletters, promotional emails ... etc which you may choose not to share with us. However, some details might be mandatory to book/cancel services of Og Travel. Hence, customers cannot proceed without providing the necessary details.

Profile Information

Og Travel will request for customer details such as name, address, telephone, Email Address, date of birth, gender ... etc to become a registered member of Og Travel. This would make the process easier for the customer while making a reservation with Og Travel since the already provided information will get auto filled during booking. A customer can always edit their profile.

Booking Information

Og Travel will require customers to enter their primary details such as name, telephone no., Email Address, date of birth, details of travel, co-passengers ... etc to make a reservation. If you are booking for a traveler other than yourself, you have the sole responsibility of that persons’ information which you have provided to us at the time of booking.

Payment Information

Og Travel will require customer to provide credit/debit card number, card holder name , Passport Expiration Date , CVV ... etc during payment via payment gateways to confirm their reservations.

We will use personal information for the following:

a)    To process your flight/hotel/any Og Travel service, send itinerary (confirmation of booking/any transactions) or contact you if there is any problem with your reservation.

b)    To register with our application and subscribe our services. You can unsubscribe from these services at any time of your choice.

c)    To inform you of any promotional offer.

d)    To address your customer care queries/complaints.

e)  To perform statistical analysis of user behavior and characteristics in order to measure interest or use of the various areas of the site, including advertisements. Only aggregated data from these analyses will be provided to third parties. 

f)     To review, develop and improve the services we offer you.

Og Travel may collect information regarding the domain and host from which you access the Internet, the Internet Protocol (IP) address of the computer or Internet Service Provider you are using, web browser being used and other statistical data. This information may be used to ease the next usage of Og Travel by the customer or to prompt the customer regarding security measures if attempted to login from a different IP.

Changes to Privacy Policy

Please note that we may make periodical changes to our privacy policy after review and it will be available in our application. Hence we encourage you to review  the privacy policy in our application for the latest version.

Cookies policy

Cookies are nothing but small text files stored by your browser or a particular/almost any application on your computer. This will help the application identify your device the next time you visit. This may be used to automatically log you in or remember your settings depending on the cookie placed by the application. The application cannot access any information on your computer other than the cookie it has set.

Cookies may be used to track your application search history. They track your activities or movements within the application such as remember your registered login, preferences, to resume where you left off and other customization.

Cookies are not executable files. Hence are harmless. Cookies pose no risk since neither they contain virus in any form nor do they spy on your PC content to compromise security.

We use cookies in Og Travel to serve you better and personalize your experience with our application as well as advertisements. They are intended to help you access our application faster and more efficiently. Apart from improving user experience they also provide us with certain analytics which would help us understand how the application is being used and its effectiveness. This helps us improve/enhance our application to by adding more features.

Cookies may also be used by advertisements on our application. These are only used for tracking the effectiveness of advertisement placed on our application. Aggregate data of cookies may be shared with third parties for their promotional and marketing activities. No personal information will be collected via cookies.

Please note that if a user wishes to opt out of cookies, he/she can control cookies in our application by denying a cookie in its pop up window or block cookies in a browser. However, certain features to enhance user experience in our application are served by cookies. Hence removal of cookies may affect/degrade the performance and user experience of our application.

Og Travel Cancellation Policy

•           Cancellation (this will apply to all passengers in the ticket) can be done only for refundable tickets. For Cancellation please contact our 24/7 customer support at +965 22240111 , +965 22240110 . In addition to the airline cancellation charges, Og Travel will charge KD 10.000 per passenger per segment for each cancellation. (Every booking made on Og Travel.net is subject to cancellation charges levied by the airline, which may vary by flight and booking class and some booked fares may be non-refundable per the specific airline's policy.)

•           The modification and cancellation penalties of the ticket may vary depending on the airlines. For details, please check the cancellation policy of the respective airline.

•           Customers are not entitled for refunds in case of cancellation of non-refundable tickets.

•           All tickets are subject to cancellation penalties. Please note that partially, or half-utilized tickets are non-refundable. 

•           All refunds will be processed to your card/Og Travel wallet, as the case may be, used while booking within 14-15 business days.

•           Modify Booking - Date Change of booked tickets, or changes to a few passengers within a ticket may be possible depending on the airlines. Please contact your respective airlines directly for such changes. Or, you may contact our customer care for guidance.

•           If passengers do not board, i.e., NO SHOWS, customers shall contact their respective airline for refunds, which may or may not be depending on the airline policy.

•           In the case of fares, which are discounted, depending on certain rules and regulations, airlines may restrict upgrade of ticket from one cabin class to any higher class. For any clarifications, please contact the respective airlines.
